ML assists lenders by providing our clients prove-ups for marketable title on mortgaged properties, and identifying any ownership issues (i.e., record title and/or contractual title). We also assist lenders by preparing their deeds of trust, financing statements and, most importantly, accurate descriptions for all oil and gas leases, wells and related properties included on the exhibits to the financing instruments and, thereafter, ensuring the same are properly filed and recorded to perfect the liens associated with these instruments. ML has also been called upon to review these type of financing instruments and evaluate the validity and enforceability of the liens associated them, including in bankruptcies.
